Mining licences may be obtained through tender procedures. Both tender and licensing procedures may be subject to administrative and judicial challenges. Where the permits specified under Article 7 of the Mining Law cannot be obtained for an area awarded through a tender, this may give rise to the administration’s liability for damages. Furthermore, unlawful conduct in tender procedures may result in criminal liability for those involved and may also lead to their exclusion from participation in subsequent mining licence tenders.
